TERMS OF SERVICE

All users are required to digitally certify that they have read, understood and agreed to these terms before transacting with us. Please review them carefully and contact us for clarification as needed.

Introduction:

1. Leads Focus LLC is headquartered at… and referred to as "Leads Focus" or "we".
2. The individual or organization transacting with Leads Focus and thereby certifying agreement with these terms is referred to as "you".
3. Emails, SMS messages and social media interactions are referred to as "communications".
4. These terms of service are a legally binding agreement between Leads Focus and you. They constitute the legal basis for use of the service.

General terms:

1. If you are using our service as part of an organization, then you certify that you have the authority within said organization to legally bind it to these terms.
2. Leads Focus reserves the right to amend any part of these terms at our discretion and it is your responsibility to check periodically for updates.
3. You certify that any dispute resolution proceedings will be conducted on an individual basis and not through class or representative action.
4. Leads Focus is based in the United Arab Emirates (UAE). We make no claim that the service or data that we provide is appropriate for use in other jurisdictions. If you or the recipients of your communications are based outside of the UAE, then you assume full responsibility for compliance with local laws and regulations. All matters relating to Leads Focus, our website, services, data, terms and any disputes arising therefrom will be governed and construed in accordance with the laws and regulations of the UAE.

Your responsibilities:

1. The data that you obtain from Leads Focus will not be:
• distributed or sold to any third party
• used in the provision of a competing product or service

You certify that this clause applies even if data obtained from Leads Focus is combined with data from other sources.

2. You will not disclose Leads Focus as a source of data in your communications.
3. You certify that you have measures in place to keep the data that you purchase secure and confidential.
4. You will comply with all laws and regulations that govern or prohibit the sending of unsolicited emails.
5. You will not use our service to send automated telephone calls.
6. You will not use our service in a way that violates the laws or regulations of the jurisdiction in which:
• you reside or conduct business
• the recipients of your communications reside or conduct business
7. You will not use data obtained from Leads Focus to advertise products or services that could lead to reputational damage. This includes, but is not limited to pornography, gaming and health supplements of dubious efficacy.
8. You will not use our service to market high-risk investments to unsophisticated investors or high-interest loans to prospective creditors.
9. You will not use our service in a manner that could result in civil or criminal liability.
10. Your communications will not be misleading, inflammatory, obscene or otherwise objectionable by the standards of a reasonable person, and they will not be used to harass recipients or cause emotional distress.
11. You will not impersonate any individual or organization in your communications or misrepresent your identity.
12. You will not use our service in a way that violates any existing agreement that you have with a third party.
13. You will comply with the following:

• Privacy and Electronic Communications Directive
• California Consumer Privacy Act ("CCPA")
• CAN-SPAM Act of 2003
• All equivalent, amending or replacing legislation

Disclaimer of warranties:

1. Leads Focus provides data on an "as is" basis, without warranties of any kind, whether express or implied, including but not limited to, the warrant of title, merchantability, non-infringement, accuracy and fitness for a particular purpose.
2. We do not warrant that the data we supply is accurate, complete, compliant or suitable for any specific use. The data that we supply is purely for information purposes and should not be relied upon in any way.
3. We do not warrant that the individuals or organizations listed on our website have consented to receiving communications from our clients or users.
4. We cannot guarantee that your purchase of data will result in higher sales volumes or any other commercial benefit.

Indemnification:

1. You agree to defend, indemnify, and hold harmless, Leads Focus, its directors, employees, affiliates and associates against all third-party claims, damages, obligations, debts and expenses.
2. Leads Focus will not, under any circumstances, be held liable for your usage of data supplied or for consequences arising therefrom.
3. Use of data obtained from Leads Focus, including use which abides by these terms, involves risk, both legal and commercial, for which you agree to bear full responsibility.
4. Leads Focus will not be held liable for any damages, irrespective of whether said damages are foreseeable.
5. We will not be held liable for fines, penalties, loss of revenue, loss of profits, loss of licenses, loss of goodwill or any other damages arising from use of our data, commercial or otherwise.
